Terms of Service – SianCard (App)

1. Acceptance of Terms

By downloading, installing, or using SianCard (“Service”, “App”), you confirm that:

• You have read, understood, and agree to these Terms of Service.
• You also agree to our Privacy Policy.
• You are legally capable of entering into a binding agreement under the laws that apply to you.

If you do not agree to these Terms, please stop using the Service immediately.

2. Accounts and Security

• You may need to sign up or sign in to an account to use the core features of SianCard.
• You are responsible for maintaining the confidentiality of any login credentials or links used to access your account.
• You are responsible for all activities that occur under your account.
• If you become aware of any unauthorized use or security breach, you should notify us as soon as possible.

We reserve the right to suspend or terminate accounts that we believe have been compromised or misused.

3. Acceptable Use

You agree not to use SianCard to:

1. Engage in any unlawful, fraudulent, or harmful activity.
2. Infringe the rights of others, including copyrights, trademarks, privacy, or other legal rights.
3. Create, upload, save, or share content that:
   • Is violent, pornographic, hateful, or discriminatory
   • Is spam, misleading, or has malicious intent
4. Attempt to hack, penetrate, or disrupt the Service, servers, or networks.
5. Use automated scripts, bots, or excessive requests that place unreasonable load on our systems.

If we reasonably believe that you have violated these Terms, we may suspend, limit, or terminate your access to the Service without prior notice.

4. User Content

• “User Content” means links, text, notes, tags, and any other information you save or store within SianCard.
• You remain the owner of the rights in your User Content.
• By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to:
  • store, process, and display your User Content
  • solely for the purpose of operating, maintaining, and improving SianCard for you and providing the Service to you.

You represent and warrant that:

• You have the necessary rights to save and use the User Content in SianCard.
• Your User Content does not violate applicable laws or the rights of others.
• If your User Content contains personal data of third parties, you have an appropriate legal basis (such as consent) to process that data.

We may remove or restrict access to User Content that we reasonably believe violates these Terms or the law.

5. Third-Party Services and External Links

SianCard works with content originating from third-party platforms such as Facebook, Instagram, TikTok, YouTube, and others via shared links. These platforms are not controlled by us.

• Your use of those platforms is governed by their own terms and policies.
• We are not responsible for the content, policies, or changes on those external platforms.
• Unless explicitly stated, we are not officially affiliated with those services.

Any links to third-party websites or services are provided for convenience only, and we do not endorse or assume responsibility for them.

6. Changes, Modifications, or Discontinuation of the Service

We may:

• Update, enhance, or modify certain features of SianCard from time to time.
• Temporarily or permanently suspend specific features.
• Discontinue the Service in whole or in part, with or without prior notice, especially in cases of technical, security, or legal necessity.

We will use reasonable efforts to inform you about major changes where appropriate, but we may not always be able to give advance notice.

7. Disclaimer of Warranties

SianCard is provided on an “as is” and “as available” basis.

We do not guarantee that:

• The App will be error-free or uninterrupted at all times.
• All information stored or displayed will be accurate, complete, or up-to-date at all times.
• The Service will always meet your expectations or specific requirements.

To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent allowed by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or revenues, arising from your use of or inability to use the Service.
• If you are entitled to claim damages from us, our total aggregate liability to you for all claims relating to the Service will be limited to the amount you paid us for the Service (if any) during the 3 months immediately before the event giving rise to the claim, or the maximum amount permitted by law, whichever is lower.

9. Changes to These Terms

We may update or modify these Terms of Service from time to time. When material changes are made, we may notify you via the app or other appropriate channels.

By continuing to use SianCard after such changes take effect, you agree to the updated Terms.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict of law principles.

Any disputes arising out of or relating to the use of SianCard shall be resolved in accordance with the applicable dispute resolution procedures under Thai law.
